apital is a Latin word &
it generally indicates the cut off the head means capital portion of our body.
Now most of the countries already abolished the death penalty. 97 countries all
over the world has abolished death penalty forever, 36 countries did not
use it since last 10 years & only 57 countries continue this process. Out
of which most popular countries are India, Indonesia, republic of China, USA (5
states).
Since 1995 only 3 people have been executed in India Ajmal Kasab 2012(Terrorist), Dhanonjoy Chatterjee 2005(Rape Case) and
Auto Shankar 1995 (six murders). As
per the official government statistics since independence only 52 people have
been executed. However, the figure is in dispute because some other agencies
claim that the number is too high. The point which I wanted to make here that
capital punishment itself is barbaric law and must be thrown out of the
system.
Now coming to this case of awarding capital punishment we all know that
one of the culprit who is below 18 years cannot be awarded death penalty
inspite of the fact that the other culprit mentioned that most of the brutality
bought on the girl was by the minor only. So the person who has performed the
rarest of rare crime is already free from death penalty.
The first point which I want to make is that I am not asking anybody to
excuse the cruelty bought down by these animals on the girl. If I would have gun
in my hand I might have shoot all of these criminals. But the court has to
decide and take a much more evolved decision. Because the bigger question is we
have to stop these rape cases.
Capital Punishment in any case will not help in reducing the number of
heinous crimes. Dhanonjoy was being hanged for the rape but did it reduce the
rate of the rape case? The statistics say that the answer is clear cut NO.
Doesn’t it answer the simple question that death penalty is not the solution
for reducing the crime cases.
CAPITAL PUNISHMENT IS
CORRECT:-
1.
The supporters of the capital punishments say that this punishment will
instill the fear which will prevent the occurrence of such kind of crimes
further. But I think that this will only kill the sinner we want to kill the
sin.
2.
The other argument is that if we will let them loose then these
criminals will again pollute the society with the heinous crime. I completely
agree to them but I don’t think to prevent this we require capital punishment
there are other ways also.
MORAL ISSUES:-
1.
We in the so called civilized society teach value to our children that
vengeance is not good. An eye for an eye
makes the whole world blind. Does this notion is not violated in the
Capital Punishment? Believe me or not but yes Capital Punishment is nothing but
a revengeful act.
2.
Another question is who suffers after the criminal is executed it is he
or his family. If one really thinks that the whole family should receive the
punishment then good go ahead with it but won’t it be the most inhumane thing
we are doing just because we are making the laws.
3.
We have not created the life then who are we to take one’s life.
4. I don’t know how many
death sentence has anyone witnessed but those who have witnessed has said it is
the most inhumane thing a person can do to other being that is why governments
are trying to find some way to minimize the pain while execution.
TECHNICAL ISSUES:-
1.
Slowly and slowly we are trying to eliminate this system but if you will
again bring it back then we inevitably will be executing innocent people.
2. We all are crying for
fast track courts but once the court has to decide to go ahead with the capital
punishment. Then it becomes a more critical issue and the judgment gets
delayed. As a result the whole purpose of punishment is lost.
3. Does Capital
Punishment is really the proportionate punishment for the crime?
4. Also the doctors, social
workers, who normally treat the victims have filed an amicus brief to strike
down the law because it doesn’t protect people but it makes it less likely that
these crimes will even be reported.
One important point about the recent incident is that it has been
politicized too much. Now just to gain votes by attracting people’s emotional
support all the political parties are supporting them. The ruling party is not
commenting anything but there acts seem to be against death penalty however the
final decision has to be made by judge.Now, what I think is that a normal person cannot do this; there is
really some kind of abnormality which all these people are suffering from. We
should take them for a psychological study. It might helps us in knowing why
they committed this sin if the root is no fear because of weak law make the law
strict, if the root is no fear from the police then make police strong, If the
root is related to porn movies ban them completely. My point is that we should
think what should be done so that these kinds of incidents should be avoided in
future.
